Nonunbub Terms of Service

These Terms of Service ("Terms") govern your use of the Nonunbub website (https://www.nonunbub.com), apps, and related services (the "Platform"), operated by BABAGROUND Inc. ("BABAGROUND", "we", "us"). By creating an account or using the Platform, you agree to these Terms. If you do not agree, please do not use the Platform.

1. Our Role and Your Contract

Nonunbub is a platform for booking tours, activities, and local experiences (the "Experiences") that take place in the Republic of Korea. The Platform lets customers, including visitors traveling to Korea, browse, book, and pay for Experiences. Experiences are offered in two ways:

  • Nonunbub-Operated Experiences — provided and sold directly by BABAGROUND. The contract is between you and BABAGROUND, and we are responsible for providing the Experience as described, subject to Section 7 and applicable law.
  • Host Experiences — provided by independent third parties (the "Hosts"). The contract is between you and the Host. We act only as an intermediary connecting you and the Host, and where we collect payment we do so as the Host's agent. We are not the provider of, or a party to, a Host Experience.

Each listing shows which type it is. "Guest" means any customer who books an Experience.

2. Accounts

You must be 18 or older and able to enter into a binding contract. Provide accurate information, keep your login credentials secure, and you are responsible for activity under your account. Tell us at help@nonunbub.com if you suspect unauthorized use.

3. Bookings and Payment

Prices, taxes, and fees are shown before you book. A contract forms when your booking is confirmed, with BABAGROUND for Nonunbub-Operated Experiences and with the Host for Host Experiences. Payments are handled by third-party payment providers, and we do not store your full card details.

4. Cancellations and Refunds

The cancellation and refund policy that applies is shown before you book, set by BABAGROUND for Nonunbub-Operated Experiences and by the Host for Host Experiences. If a confirmed Experience is cancelled or is not substantially as described, you may be entitled to a refund under that policy. We are not responsible for events beyond reasonable control, such as weather or government action.

5. Responsibilities and Conduct

Hosts are independent providers, not our agents, and are responsible for their Experiences, including the accuracy of listings, required licenses and insurance, safety, and taxes. As a Guest, you agree to provide accurate information, follow the provider's reasonable safety instructions, and ensure you are able to take part. You agree not to use the Platform unlawfully, transact off the Platform to avoid fees, harass others, post false or infringing content, or misuse or scrape the Platform. We may suspend or remove access for violations.

6. Content and Reviews

You keep ownership of the content you submit and grant BABAGROUND a worldwide, non-exclusive, royalty-free, sublicensable license to host, display, and promote it in order to operate and market the Platform. You confirm you have the rights to it and that it does not infringe others. Reviews must be honest. We may remove content that violates these Terms or the law.

7. Disclaimers, Risk, and Liability

Host Experiences and the Platform are provided "as is", and we do not warrant the quality, safety, or legality of Host Experiences or the accuracy of listings. Many Experiences involve physical activity with inherent risks, which you accept and take part in at your own risk. To the fullest extent permitted by law, we are not liable for indirect or consequential damages, and our total liability is limited to the fees you paid us in the prior 12 months or USD 100, whichever is greater. Nothing here excludes liability that cannot be excluded by law, including for our intentional or grossly negligent acts, and these limits do not reduce a consumer's non-waivable rights.

8. Indemnification

You agree to cover claims, damages, and reasonable costs (including legal fees) arising from your use of the Platform, your content, your breach of these Terms, or, for Hosts, the Experiences you provide.

9. Termination

You may close your account at any time. We may suspend or end your access for breach, where required by law, or to protect the Platform or its users. Confirmed bookings in progress are handled under the applicable cancellation policy. Sections 6 through 8 survive termination.

10. Changes to These Terms

We may update these Terms and will give reasonable notice of material changes, for example by posting them on the Platform. Continued use after they take effect means you accept them.

11. Governing Law

These Terms are governed by the laws of the Republic of Korea, with the Seoul Central District Court as the exclusive forum. This does not deprive you of mandatory consumer protections in your country of residence, where you may also be entitled to bring proceedings.

12. General and Contact

These Terms are the entire agreement between you and BABAGROUND regarding the Platform. Our brand, software, and content are protected and may not be used without permission. If any provision is unenforceable, the rest remains in effect, and our failure to enforce a right is not a waiver. You may not assign these Terms, and we may assign them in connection with a merger or sale. The English version controls.
